Free entries received within 48 hours of the Closing Date (if tickets remain unallocated) will not be entered into the draw but will receive equivalent credit for paid entries on your Website account. In such a case, you must still provide all of the required information in Section 2.7.2 for each Free Entry requested.
- If the Promoter determines that standard postage fees exceed the Competition’s paid entry fee, or to ensure Free Entry is no less convenient than paid entry, the Promoter may also offer an online Free Entry route. Where available, instructions for the online Free Entry route will be set out clearly on the Competition webpage, alongside the paid-entry details
- For either free route, you must have an active account on the Website matching the information in your free entry. Free entries cannot be processed if your posted details do not match the Website account details (e.g., different email address). You can register at https://atvcompetitions.com/register/ before or after mailing your free entry, but you must do so before the Closing Date to be included in the draw.
- Any participant entering via a Free Entry will be entered into the relevant draw on the same basis as paid entrants. Free Entries have an equal opportunity to win any Prize offered in the Competition, and Winners are chosen randomly among all qualifying entries (paid and free).
- You may enter each Competition without paying a fee (“Free Entry”) by following one of the methods described below. - THE PRIZE
- Each Competition’s specific prize(s) (“Prize”) is described on the Website. The Promoter makes reasonable efforts to ensure the Prize description is accurate and up to date at the time of the Opening Date. Images or depictions of the Prize on the Website or in marketing are for illustrative purposes only. Any stated value is based on the best available estimate or recommended retail price. The Promoter does not guarantee resale value or market valuations. Furthermore, the Promoter makes no other representations or warranties regarding the Prize, its value, condition, or any other details provided on the Website.
- Prizes are subject to availability. The Promoter reserves the right to substitute any Prize with one of equal or greater value. In the event of any changes to the Prize details, the Promoter will make reasonable efforts to update the Website as soon as possible. For Instant Win Competitions, the Prizes listed on the Website are those available to be won. However, there is no guarantee that all such Prizes will be awarded, and the number of Prizes won will depend on the number of entries.
- No cash alternative is available for the Prize unless explicitly stated for a specific Competition. However, the Promoter may, at its sole discretion, offer a cash alternative if the Winner prefers cash over the Prize.
- The Prize is non-refundable, non-negotiable, and non-transferable.
- If the Prize is a vehicle:
- The Promoter will ensure the vehicle, unless otherwise stated, comes with a valid MOT (if required). The Promoter is not responsible for any mechanical or cosmetic issues not apparent at handover, but will disclose any known defects or relevant history.
- No insurance is included with the Prize, and it is the Winner’s responsibility to ensure the vehicle is adequately insured before using it on public roads (if permitted).
- The Promoter bears no responsibility for the Prize once delivered. The Winner is solely responsible for complying with all relevant laws and regulations concerning the vehicle, its operation, and ensuring it is used safely.
- The Prize does not include vehicle/road tax or fuel.
- The Winner is responsible for ensuring they hold the necessary licenses, qualifications, knowledge, and experience to operate the vehicle legally and safely.
- The Winner is responsible for obtaining and wearing all necessary safety equipment, including helmets, boots, and gloves, while operating the vehicle.
- By accepting the vehicle Prize, the winner acknowledges that they assume all ongoing responsibility for operating the vehicle safely and in compliance with all laws.
- If the Prize is a holiday or event:
- The Prize description will specify the number of tickets, the class of transport, the type of carrier, and the travel destination. Depending on the type of Prize, there may be flexibility in the travel dates (e.g., a Grand Prix ticket may have a fixed date, while a general holiday may offer flexible dates). Excluded dates for holiday prizes will be listed on the Website.
- Unless explicitly stated, the Winner is responsible for arranging travel to and from airports, train stations, or event locations. Any travel insurance, spending money, meals, or personal expenses are also the Winner’s responsibility.
- A cash supplement may be included in the Prize if expressly stated on the Website. The Promoter’s liability is limited to the Prize as described on the Website.
- The Winner and any guests are solely responsible for ensuring they hold valid passports, visas, and other travel documents before travel. Failure to obtain required documents does not entitle the winner to a cash alternative or any form of compensation.
- If an event is cancelled or rescheduled by the organizer or supplier, the Promoter will make reasonable efforts to find an alternative or offer a suitable substitution. The Promoter is not liable for circumstances beyond its control (e.g., strikes, pandemics, or acts of God) but will work in good faith to resolve the situation.
- Limitations of Liability: The Promoter will not be liable for any loss or damage suffered by any Winner resulting from: (a) their operation of a vehicle, (b) their travel arrangements, or (c) any personal injury or property damage, except where caused by the Promoter’s negligence or fraud.
- Acceptance of Prize: By accepting the Prize, each Winner agrees they have read and understood the conditions and disclaimers associated with it (e.g., vehicle safety, holiday date restrictions). No responsibility is taken for winners Who fail to follow these conditions, leading to forfeiture of the Prize or personal loss.
- REFUNDS AND DATE CHANGES
- No Routine Refunds: Entry fees are generally non-refundable once a Participant has entered the Competition.
- Significant Changes or Cancellation: If the Promoter cancels a Competition entirely or makes a material change (e.g., extending the Closing Date by more than 120 days, significantly altering the prize, etc.) that reasonably disadvantages Participants, the Promoter will promptly notify all affected Participants. In such circumstances, Participants may request a full refund of any paid entry fees within 14 days of receiving notice of the change.
- Minor Extensions: The Promoter reserves the right to extend the Competition Closing Date by a short period (e.g., a few days) if absolutely necessary (e.g., technical malfunctions, force majeure). Minor extensions will not typically warrant refunds, but the Promoter will endeavour to be transparent about any changes.
- Procedure for Refunds: If a refund is issued, it will be processed using the original payment method where possible, or another method at the Promoter’s discretion if the original is unavailable. Refunds apply solely to paid entrants; no compensation is due for Free Entries.
- DATA PROTECTION & PRIVACY
- By entering any Competition, Participants provide personal data (e.g., name, address, email). The Promoter is the Data Controller for these purposes.
- The Promoter will use Participants’ personal data solely for the administration of the Competition (e.g., verifying eligibility, contacting winners). It may also be used for direct marketing if the Participant opts in, in accordance with applicable law.
- The Promoter processes personal data under the legal basis of performance of contract and legitimate interests (where relevant). Participants have the right to access, correct, erase, or restrict their data and can withdraw consent for marketing at any time.
- For more information on how the Promoter handles personal data, including transfers, security measures, and retention periods, please see our www.atvcompetitions.com/privacypolicy.
- The Promoter may retain details of winners for a reasonable period (e.g., up to 6 years) to meet legal or regulatory requirements, after which data will be securely deleted or anonymized.
- LIMITATION OF LIABILITY
- Nothing in these Official Rules excludes or limits liability for death or personal injury caused by the Promoter’s negligence, or for any other liability that cannot be excluded or limited under English law. Your statutory rights remain unaffected.
- Subject to the above, and insofar as permitted by law, the Promoter, its agents, or distributors shall not be liable for any loss or damage arising from:
- Participant errors (e.g., entering incorrect details),
- Unauthorized access or destruction of entries,
- Technical failures beyond the Promoter’s control (e.g., network outages, third-party software malfunctions),
- Unavailability of the Website or entry methods, or
- The Winner’s use or enjoyment of the Prize, except where caused by the Promoter’s negligence.
- The Promoter will take reasonable steps to ensure the Competition runs smoothly (including addressing any technical issues within its control). Where a significant technical problem prevents a fair outcome, the Promoter may implement a fair remedy (e.g., extending the entry period, providing refunds) in accordance with Section 11.3.
- The Promoter is not responsible for any third-party products or services forming part of the Prize, such as holiday providers or event organizers, except to the extent required by law. If a third party fails to honour arrangements, the Promoter will use reasonable efforts to help the Winner secure a comparable alternative but makes no guarantee of success.
- DISPUTE RESOLUTION
- Initial Contact: If you have any concerns or disputes regarding a Competition, please contact the Promoter at at admin@atvcompetitions.com. The Promoter will attempt to resolve such issues amicably and promptly.
- Optional Arbitration: At the Promoter’s discretion, the Promoter may offer to resolve disputes through an independent arbitration procedure. This option will only apply if both parties voluntarily agree to it in writing after the dispute arises.
- Governing Law & Jurisdiction: Unless otherwise required by mandatory consumer protection laws, these Official Rules (and any dispute arising out of them) are governed by the laws of England and Wales. You retain the right to pursue legal claims through the courts of England and Wales if you do not wish to use arbitration or if arbitration is not mutually agreed upon.
- Class/Collective Actions: As far as permitted by law, disputes are dealt with on an individual basis. This does not override any statutory right you may have to join or bring collective proceedings where allowed under UK law.
- GENERAL
- The Promoter reserves the right to amend these Official Rules from time to time. Any material changes affecting Participants who have already entered will be communicated via email (where possible) and posted on the Website, allowing Participants a reasonable period (14 days from notice) to withdraw and receive a refund if they are significantly disadvantaged by the change.
- If the Promoter reasonably believes you have breached these Official Rules or engaged in any fraudulent or abusive conduct, the Promoter may exclude you from current or future Competitions. Where feasible, you will be informed of the suspected breach and given an opportunity to respond before a final decision is made.
- The Promoter reserves the right to hold void, suspend, cancel, or amend a Competition if circumstances beyond its reasonable control make it necessary to do so. In such cases, paid entry fees will be refunded to the extent feasible. Minor operational changes (e.g., a short extension due to technical issues) may not warrant refunds unless Participants are significantly prejudiced.
